Public Option Legislation:  U.S. House of Representatives

H.R. 3200 was introduced in the House of Representatives on July 14.  Its official title:  "To provide affordable, quality health care for all Americans and reduce the growth in health care spending, and for other purposes."  Its short title:  "America's Affordable Health Choices Act of 2009".

H.R. 3200 has been superseded by H.R. 3962, the "Affordable Health Care for America" Act.  This bill passed the House on November 7, 2009, and blends and updates the three versions of H.R. 3200 passed by the three House committees in July.  This bill does include a version of the public option.

  Public Option Legislation:  U.S Senate

  Current Bill

Senate Majority Leader Harry Reid prepared a bill that blends the HELP Committee bill and the Finance Committee bill.  (See below for more information on these bills.)  The blended bill, H.R. 3590, the “Patient Protection and Affordable Care Act of 2009”, includes a public health insurance option that a state may opt-out of.  On November 21, 2009, the Senate voted to proceed to debate on H.R. 3590.*

*Why is the Senate bill numbered like a House bill?  H.R. 3590 is the “legislative vehicle” for the version of health care reform (the blended bill prepared by Senator Reid) that will be debated in the Senate.  This Senate legislation is an amendment to H.R. 3590.  H.R. 3590 is an existing House bill.
